| Court Denies Requested Inspection of Camera Phone |

In Green v. Fluor Corp., 2009 WL 1668376 (M.D. La. June 11, 2009), U.S. Magistrate Judge Stephen C. Riedlinger denied defendants' request to inspect plaintiff's email account and camera phone for a particular photograph. Plaintiff had previously produced an electronic image of a photograph from his cell phone. Defendant sought to inspect plaintiff's camera phone and email account to presumably get a higher quality image. The court denied the request noting that defendants did not request data from plaintiff's phone or email account in their discovery requests and were not entitled to the wholesale reproduction of electronic information where they failed to specify a form of production in their discovery requests. The court also ruled that defendants had offered no basis to contest the authenticity of the photograph. The court further awarded $200 to plaintiff to cover plaintiff's cost in opposing the motion. |
