The University of Arizona James E. Rogers College of the Law Convocation recently featured an address from Law College Association President and Ryley Carlock and Applewhite Shareholder Jeff Simmons

Simmons, above at the podium during his address on May 16, noted that the new class joined a network of nearly 7,000 alumni around the world who "serve each other, their communities, their profession, and the College that launched their lives in the law."

Simmons graduated from the University of Arizona College of the law in 1986, and serves as Chair of the Litigation Department at Ryley Carlock & Applewhite.

Ryley Carlock Partner Carolyn Burr Appointed by Governor Ritter to Colorado Ground Water Commission

Carolyn Burr, a shareholder in the Denver offices of Ryley Carlock and Applewhite, was recently named to the 12-member Colorado Ground Water Commission. Burr was appointed to represent Front Range municipal and industrial users on the Commission, and will serve a one-year period, commencing May 1, 2009.

Under Colorado's Ground Water Management Act, the Ground Water Commission has authority to determine designation of ground water basins, create and adopt rules and policy, and review requests for variance of its rules and policies. The Commission also hears or reviews protests to decisions by the Ground Water Commission hearing officer and acts as final administrative authority.

Burr, who in 2008 was selected as one of Colorado Law Week's Women Lawyers of the Year, is a third-generation Colorado rancher, and has focused her legal practice on the complex issues surrounding water in the state for more than a decade.

MARICOPA COUNTY REAL PROPERTY TAX APPEAL PROCEDURE

The County Assessor has mailed out valuation notices to the owners of real property setting forth the Assessor's proposed real property valuations for the 2010 tax year. The Assessor is required to value all real property in the County by December 15th of each year, and the valuation notices are required to be mailed by March 1st. The notices are usually sent out between January 15th and the end of February, and address to establish the valuation of the real property for the tax year following the year in which the notices are sent. If you were not the owner of the property on that date, then you may not receive a valuation notice. These valuations are available online at www.maricopa.gov/assessor

Does an Arizona monetary judgment expire?

In the latest installment of Ask the Attorney, as featured in the Phoenix Business Journal, creditor's rights attorney Scott Jenkins answered the following question:

Does an Arizona monetary judgment expire?

In Arizona, a monetary judgment expires five years after the date of its entry, unless the judgment is renewed. A judgment may be renewed by instituting an action or filing a renewal affidavit within ninety days of the five year period with the clerk of the proper court. An Arizona judgment lien must also be renewed within the five year period by recording a certified copy of the renewal affidavit with the applicable county recorder's office. As long as the judgment creditor complies with the renewal requirements, there is no limitation on the number of times a judgment or judgment lien may be renewed.

Firm Assists Plan Administrators Avoid DOL Penalty

The firm recently received U.S. Department of Labor notice stating that the agency had considered and accepted in full a "statement of reasonable cause" the law firm had designed on behalf of its client, the Administrator of a Profit Sharing Plan, and the arguments contained in the statement. The DOL waived 100% of an asserted six figure penalty imposed on the client. The arguments in the statement of reasonable cause were developed and drafted by Tara Pauls and Chris Siegle in their capacity as counsel to the Plan Administrators of the Profit Sharing Plan.

Arizona Governor Napolitano Appoints Robert Shuler to Water Quality Assurance Revolving Fund Board

Robert Shuler, a shareholder at Ryley Carlock & Applewhite, has been appointed by Governor Janet Napolitano as the agricultural representative on the Water Quality Assurance Revolving Fund Board.

The Water Quality Assurance Revolving Fund (WQARF) was created under the Environmental Quality Act of 1986 to support hazardous substance cleanup efforts in the state. The fund is comprised of legislative appropriations, cost recovery from responsible parties, corporate income tax and special fees, and is applied to sites identified as most in need of cleanup statewide.

Shuler has 30 years of governmental, legal and business experience in Arizona and California and advises a wide array of clients in the West on legal and governmental affairs.

Background on the Mike Brophy Scholarship:

The Mike Brophy Scholarship is a living tribute to distinguished lawyer, family man and friend. The Mike Brophy Scholarship was established at the Sandra Day O'Connor College of Law at Arizona State University with a matching grant from Phelps Dodge Corporation. The scholarship honors Mike Brophy, a member of the Class of 1977, who spent his entire legal career at Ryley Carlock & Applewhite. Mike was a man of few words who valued honesty, courage and loyalty above all other traits. During his career, Mike became nationally recognized as a water lawyer. He served as the Arizona Representative to the Western States Water Council from 1991-2002 and served as Chairman of the Council from 2000-2002. Mike was also the Chairman of the Water Policy Committee for the Greater Phoenix Chamber of Commerce. Mike was perhaps most proud of his work negotiating and securing the enactment of legislation by the United States Congress involving water rights and settlements with the Gila River, Salt River Pima-Maricopa, Fort McDowell, and Ak-Chin Indian communities, and the San Carlos Apache Tribe.

Mike built the firm's natural resources practice and served as the group's practice leader. He served as the firm's managing partner from 2003 to 2004. In addition to his leadership at the firm, Mike was recognized for his water law expertise by several organizations, including the Chambers USA America's Leading Lawyers for Business: The Clients Guide, The Best Lawyers in America, and the Who's Who Legal USA: Environmental.

Mike's retirement goal, personally unattainable because of his untimely passing, was to work to further the goals of non-profit organizations. Ryley Carlock Shareholder Elected To Notre Dame Law Advisory Board

Christopher A. Coury, a Shareholder at Ryley Carlock & Applewhite and Chair of its Litigation Department, has been elected to the Board of Directors of the Notre Dame Law Association (NDLA). Coury, who is licensed to practice in both Arizona and Nevada, was chosen to represent District 3 on the Board, an area covering Arizona, Southern California, Nevada and Mexico.
The activities of the Board of the NDLA include:

• advising the Dean and such members of the faculty and administration as the Dean may designate in matters respecting the students, curriculum, finances, programs, facilities, resources, capabilities, strategic planning, management and operations of the Law School, and such other areas as the Dean may specify in requesting assistance of the NDLA;
• recruiting, advising and promoting the candidacies of excellent students for the Law School;
• mentoring, advising and promoting students and graduates of the Law School in their efforts to secure employment opportunities;
• conducting such activities and programs as are designed to promote or contribute toward the mutual support of NDLA members;
• fostering a spirit of solidarity, friendship and dedication among NDLA members and friends of the University of Notre Dame and the Law School

Coury's term on the Board will be for three years.

Coury earned both his undergraduate and law degrees, cum laude, from Notre Dame, where he served as president of the Student Bar Association.

At Ryley Carlock, Coury's practice in commercial litigation concentrates on financial services litigation, trade secrets and restrictive covenants, securities and fraud litigation and business crimes.

Prior to working at Ryley Carlock & Applewhite, Coury was a Deputy County Attorney with the Maricopa County Attorney's Office from 1996 to 1998. As a prosecutor, Coury tried numerous cases as lead counsel. His final assignment was to the Gang/Repeat Offender Bureau in the Major Felony Division. Coury was an associate with O'Connor Cavanagh between 1995 and 1996, and worked as a judicial law clerk at the Arizona Court of Appeals for the Honorable Edward C. Voss from 1994 to 1995.

An article written by Mike Moberly and Andrea Lisenbee, shareholders in Ryley Carlock & Applewhite's labor and employment practice group, was published in the most recent issue of the Suffolk Journal of Trial and Appellate Advocacy. The article, To Plead or Not to Plead?: Assessing the Effect of a Partial Motion to Dismiss on the Duty to Answer, addresses whether a defendant's submission of a partial motion to dismiss extends the time within which the defendant must answer the remainder of the complaint. The article also provides practical tips for protecting the defendant's interests in the litigation, including avoiding a potential default judgment on claims to which the defendant has not responded.

Donates PC Monitors to Students Recycling Used Technology Program

When the 100-plus lawyer law firm Ryley Carlock upgraded its computer monitors in its Phoenix office this week, the 65 used monitors underwent a transformation. Instead of being viewed by lawyers reading litigation papers or deal documents, they will now entertain the eyes of local school children, as a donation to the Arizona StRUT (Students Recycling Used Technology) program.

Formed in 1997 by founding sponsors Intel & Motorola, Arizona StRUT is a partnership between local schools and businesses, where students learn new skills by refurbishing used computer equipment. The equipment is then donated to schools and other qualified non-profit organizations throughout Arizona.

"We are extremely pleased that Ryley Carlock is helping AZ StRUT support its mission through the donation of Monitors. It is our hope that others will follow suit. This will enable the students involved in AZ StRUT to enhance their career options as well as keep unused computer hardware out of our landfills," said Ken Mystrom, Executive Director, Arizona StRUT

Arizona StRUT teachers train over 800 students each year at 28 sites across Arizona. The students are given the opportunity to work on computers and get the kind of valuable hands-on experience that companies are looking for, and the completed systems are donated to non-profit organizations such as local schools and charities.

Last year alone, 349 schools and organizations received refurbished equipment (over 2,858 units) through the Arizona StRUT program. Robert L. Rodolfo Parga, Jr., Managing Shareholder of 100-lawyer Ryley Carlock & Applewhite was recently named to the Super Lawyers® Corporate Counsel Edition's list for lawyers in Arizona. Parga is among a select few in the state to be named to the list of business litigators.

Parga is the firm's Managing Shareholder. Ryley, Carlock & Applewhite shareholder Mike Moberly's article, The Disability History Mystery: Assessing the Employer's Reasonable Accommodation Obligation in "Record of Disability" Cases, was published in the December 2007 issue of the Pepperdine Law Review.  In this article, Moberly explores the question of whether an employer's duty to accommodate a disabled applicant or employee's impairments under the Americans With Disabilities Act is broad enough to apply in cases in which the individual is no longer disabled, but instead is protected by the act solely by virtue of having a history, or "record," of a prior disability.  The article discusses the limited, and conflicting, case law addressing this issue to date, and ultimately concludes that the extent to which employers are required to accommodate individuals with a disability history is likely to be resolved by the courts on a fact‑specific, case-by-case basis, just as accommodation claims are presently resolved in the "actual disability" context.

Given the complexities of tax laws, fluctuating real estate values and other concerns, many Arizonans need assistance and some advice on estate planning. “Lawyers on Call” is a partnership between the State Bar and Channel 12’s Call 12 For Action team. Once a month, Arizona attorneys volunteer to staff a phone bank and answer questions about different areas of law.

RC&A Shareholder Mike Moberly's article, Protecting Confidential Communications: Employees and Work Counseling, was published in the November 2007 issue of Arizona Attorney Magazine. The magazine, which is published 11 times a year, is the official journal for the State Bar of Arizona. In his article, Mike discusses the need to protect the confidentiality of communications between employees and Employee Assistance Program counselors, in order to promote the employee candor necessary to receive effective EAP counseling and treatment.To further this protection, Mike advocates the recognition, in Arizona, of a formal evidentiary privilege shielding most such communications from disclosure in subsequent court proceedings, subject, however, to a "dangerous patient" exception permitting disclosure when necessary to protect third persons from threats of harm made during EAP counseling sessions.

Michael D. Moberly’s article, Applying the Sham Affidavit Doctrine in Arizona, was published in the Winter 2006 volume of the Arizona State Law Journal. In this article, Mike reviews the history and application of the sham affidavit doctrine by the Arizona courts. The sham affidavit doctrine originated as a method of preserving the summary judgment process by permitting a trial court to disregard an affidavit that is inconsistent with the affiant’s prior deposition testimony. The article reviews not only the sham affidavit doctrine, but also ancillary issues, including the potential impact of the doctrine on Arizona’s procedural rules and the manner in which the doctrine effects the traditional role of the trier of fact.
