Biography:

Greg Jones is a shareholder in the firm's Litigation Group. Greg has been engaged in a broad and varied litigation practice since 1985. Greg is experienced in several areas of litigation, including commercial litigation (which includes, but is not limited to, contracts, construction law, real estate, and corporate management disputes), employment, intellectual property, and professional liability. Greg is currently focusing his practice primarily on construction law and real estate litigation. Real estate matters include contract disputes, lender actions, receiverships, easements, condemnation and nuisance. The construction matters typically handled by Greg include representation of commercial contractors, subcontractors, and owners in disputes involving payment, mechanics lien foreclosures, bonding, delays, licensing and workmanship. He also has substantial experience handling construction defect disputes, representing owners, subcontractors, contractors, architects, and engineers in litigation and before the Registrar of Contractors. Often, these defect cases involve claims of misrepresentation or failure to disclose latent defects against sellers and real estate professionals. Greg understands complex construction and engineering issues which often arise in construction and professional liability litigation, and has been involved privately as an entrepreneur in building and development projects. At the same time, his real property litigation experience and expertise are helpful, as construction disputes frequently overlap into issues of lien rights and real estate development concerns.

Examples of specific accomplishments:

• Recovered nearly $200,000 for homeowners of luxury homes with major structural defects.
• Prevailed at trial and Court of Appeals in defense of suit by developer to force sale of $4 million suburban ranch of elderly widow.
• Obtained published Court of Appeals decision reversing trial loss by others in suit to enforce unsigned acreage release provision in deed of trust.
• Negotiated six-figure settlement on behalf of lender in "waste" action against would-be developers of historic Central/El Encanto property, due to failure to maintain or protect property.
• Obtained over $400,000 settlement in fraud and breach of contract action by retail franchisee against national mattress and sofa bed manufacturer/franchiser.
• Defended software reseller in complex federal court software defect litigation.
• Defended structural engineer who was main target in large multi-defendant construction defect case.
• Tried private placement securities fraud claims through NASD arbitration against securities dealer, recovering over $100,000 and attorneys fees.
• Litigated to judgment numerous deficiency judgment actions on behalf of lenders.
• Obtained $1,000,000 judgment against general partner for breach of fiduciary duty in development of large long-term care facility.
• Currently act as corporate or general counsel for several corporations, limited liability companies and individuals regarding business, employment, risk reduction, licensing and litigation.
• Counsel clients on construction contracting and lien issues and draft liens and contracts.
• Represent a major homebuilder and developer in defending construction defect litigation.
