Donates PC Monitors to Students Recycling Used Technology Program

When the 100-plus lawyer law firm Ryley Carlock upgraded its computer monitors in its Phoenix office this week, the 65 used monitors underwent a transformation. Instead of being viewed by lawyers reading litigation papers or deal documents, they will now entertain the eyes of local school children, as a donation to the Arizona StRUT (Students Recycling Used Technology) program.

Formed in 1997 by founding sponsors Intel & Motorola, Arizona StRUT is a partnership between local schools and businesses, where students learn new skills by refurbishing used computer equipment. The equipment is then donated to schools and other qualified non-profit organizations throughout Arizona.

"We are extremely pleased that Ryley Carlock is helping AZ StRUT support its mission through the donation of Monitors. It is our hope that others will follow suit. This will enable the students involved in AZ StRUT to enhance their career options as well as keep unused computer hardware out of our landfills," said Ken Mystrom, Executive Director, Arizona StRUT

Arizona StRUT teachers train over 800 students each year at 28 sites across Arizona. The students are given the opportunity to work on computers and get the kind of valuable hands-on experience that companies are looking for, and the completed systems are donated to non-profit organizations such as local schools and charities.

Last year alone, 349 schools and organizations received refurbished equipment (over 2,858 units) through the Arizona StRUT program. Employee Benefits Practice Benefits Big Client

Tara Pauls and Chris Siegle just completed the 6-month transition of Ryley Carlock & Applewhite's largest employee benefits client.  Initally, the client had a plan created in which they had a dual 403(b) employee deferral plan and a 401(a) employer match plan, which caused the client unnecessary compliance issues.  Ms. Pauls and Mr. Siegle helped transition the company into a single 401(k) plan using the Ryley Carlock IRS pre-approved prototype plan. Robert L. Shuler, a 30-year veteran of governmental, legal and business experience in Arizona and California, and a shareholder at the law firm of Ryley Carlock & Applewhite, received Recognition for Outstanding Service to Agribusiness from the Morrison School of Management & Agribusiness at Arizona State University on March 27, 2008. Shuler is known as a strong advocate for agriculture and Rural Arizona. His current clients include Western Growers, the trade association representing the fresh fruit and vegetable industry in Arizona and California, the Arizona Pork Council, Pinal Energy, Caljet, Hickman Family Farms, Roosevelt Water Conservation District, the Town of Chino Valley, the Town of Williams, Arizona Crop Protection Association, Western Plant Health Association, and CropLife America. Rodolfo Parga, Jr., Managing Shareholder of 100-lawyer Ryley Carlock & Applewhite was recently named to the Super Lawyers® Corporate Counsel Edition's list for lawyers in Arizona. Parga is among a select few in the state to be named to the list of business litigators.

Parga is the firm's Managing Shareholder. Pepperdine Law Review Publishes Mike Moberly aticle on Disability Discrimination

Ryley, Carlock & Applewhite shareholder Mike Moberly's article, The Disability History Mystery: Assessing the Employer's Reasonable Accommodation Obligation in "Record of Disability" Cases, was published in the December 2007 issue of the Pepperdine Law Review.  In this article, Moberly explores the question of whether an employer's duty to accommodate a disabled applicant or employee's impairments under the Americans With Disabilities Act is broad enough to apply in cases in which the individual is no longer disabled, but instead is protected by the act solely by virtue of having a history, or "record," of a prior disability.  The article discusses the limited, and conflicting, case law addressing this issue to date, and ultimately concludes that the extent to which employers are required to accommodate individuals with a disability history is likely to be resolved by the courts on a fact‑specific, case-by-case basis, just as accommodation claims are presently resolved in the "actual disability" context.

Lorrie Luellig, a shareholder in the firm and a principal in its Document Control Group will present at the 4th annual Compliance, Governance and Oversight Council (CGOC) Summit, to be held on January 23-25, 2008 in Palm Springs, California.

Once a month, Arizona attorneys volunteer to staff a phone bank and answer questions about different areas of law.

RC&A Shareholder Mike Moberly's article, Protecting Confidential Communications: Employees and Work Counseling, was published in the November 2007 issue of Arizona Attorney Magazine. The magazine, which is published 11 times a year, is the official journal for the State Bar of Arizona. In his article, Mike discusses the need to protect the confidentiality of communications between employees and Employee Assistance Program counselors, in order to promote the employee candor necessary to receive effective EAP counseling and treatment.To further this protection, Mike advocates the recognition, in Arizona, of a formal evidentiary privilege shielding most such communications from disclosure in subsequent court proceedings, subject, however, to a "dangerous patient" exception permitting disclosure when necessary to protect third persons from threats of harm made during EAP counseling sessions.

Michael D. Moberly’s article, Applying the Sham Affidavit Doctrine in Arizona, was published in the Winter 2006 volume of the Arizona State Law Journal. In this article, Mike reviews the history and application of the sham affidavit doctrine by the Arizona courts. The sham affidavit doctrine originated as a method of preserving the summary judgment process by permitting a trial court to disregard an affidavit that is inconsistent with the affiant’s prior deposition testimony. The article reviews not only the sham affidavit doctrine, but also ancillary issues, including the potential impact of the doctrine on Arizona’s procedural rules and the manner in which the doctrine effects the traditional role of the trier of fact.
