The firm boasts an abundance of depth and talent in its real estate practice area, with roughly one-quarter of the firm’s attorneys devoting all or a substantial portion of their practices to some aspect of real estate. Several more of our attorneys concentrate their practices, or have substantial experience and expertise, in legal fields that complement the firm’s real estate practice, including environmental and natural resources law, business tax planning, bankruptcy and commercial litigation, and corporate and securities law, which round out the broad range of expertise needed to effectively serve our real estate clients. We are committed to the philosophy that quality service requires familiarity with the law and the client’s industry, attentiveness to detail, an appreciation of the client’s objectives and the unique aspects of each transaction, timeliness of response, and efficiency in delivery of service - in short, doing what it takes to deliver excellent work product on a timely basis for a reasonable price. We are conversant with the numerous federal, state and local laws and regulations affecting real estate, including those relating to water, mineral and other property rights, commercial leases, land use controls, condemnation, duties and liabilities of landlords and real property owners, subdivisions and lot sales, business planning and ownership, entity structuring, federal, state and local taxation, environmental issues, construction law, and title insurance. Our clients include the owners and developers of multifamily housing projects, office and retail projects, resort properties, restaurants, industrial/warehouse projects, agricultural properties, master planned residential and mixed-use communities, health care and assisted living facilities, and single- purpose projects of numerous descriptions. Our experience extends from conducting the due diligence needed to facilitate a client’s informed investment decision to coordinating negotiations with governmental authorities regarding entitlements for a given project. The firm’s capabilities are as diverse as the needs of our clients, ranging from the drafting and negotiation of commercial leases to the structuring of a private offering of equity interests in a real estate development entity. We have the depth to staff a major transaction on a tight time frame, as well as the ability to efficiently and professionally handle each of those less momentous transactions that are of such importance to our clients. Our customary approach is to staff cases conservatively, to give the responsible attorneys the greater breadth and depth of knowledge of the matter that leads to higher quality service, and to provide a more cost-effective means of delivering high quality legal services that avoids unnecessary duplication at the client’s expense. The structure and terms of financing are, of course, critical elements of most real estate transactions. The firm boasts many years of experience in virtually all forms of real estate financing, including most forms of commercial bank financing, improvement district financing, revenue bond financing, the use of deferred sale agreements, synthetic leases, subdivision trust agreements, and option agreements. In considering and negotiating project financing, we are pleased to be able to offer our real estate developer clients the insight and experience we have gained in representing many of the major banks, insurance companies, pension trusts and other financial institutions in the Arizona market for many years. |
