Ryley Carlock Attorney Richard Kaufman Represents American Petroleum Institute in Landmark Fracking Case

On May 2, 2016, the Colorado Supreme Court ruled to uphold the state’s primacy in overseeing oil and natural gas permitting, successfully ending the hydraulic fracturing moratorium in Fort Collins, Colorado. Ryley Carlock & Applewhite Shareholder Richard Kaufman successfully represented the America Petroleum Institute in City of Fort Collins v. Colorado Oil and Gas Association. The Court concluded that because fracking is of mixed state and local concern and therefore subject to preemption by state law, Fort Collins’ 5-year moratorium is invalid and unenforceable.

The America Petroleum Institute represents all segments of America’s oil and natural gas industry, including production, processing and distribution.
